ALAMO POOL BUILDERS WARRANTIES
Alamo Pool Builders fully transferable extensive Warranties commence at completion of pool plaster finish installation and warrantying its work to be free from defects in material and workmanship for a period of:
A Limited Lifetime ‐ Hold Water ‐ Structurally Sound Warranty on the Shotcrete – Gunite Shell. The Term “Limited Lifetime ‐ Hold Water – Structurally Sound” implies that the swimming pool is capable of containing and holding water. In the event of a failure to do so Contractor will repair so it holds water. The Limited Lifetime ‐ Hold Water ‐ Structurally Sound Warranty does not extend or cover items external to the pool such as: coping, coloring, plaster, plumbing, electricity, filter, heaters, decking, accessory buildings, or pool accessories. The Limited Lifetime ‐ Hold Water ‐ Structurally Sound Warranty is void if the pool is not kept full except when emptied by Contractor or should the water table be above the lowest point of the pool or should the pool be damaged by earthquake, war, earth movement, earth fill movement or of disasters not caused by Contractor such as explosions, wrecking and the like. The Limited Lifetime ‐ Hold Water ‐ Structurally Sound Warranty is void if wrong use of chemicals or from lack of cleaning. A dirty pool will break concrete !
A 10 Year Warranty against delamination or deterioration on JewelScape, StoneScape and QuartzScape. Marcite Plaster Finish has a 3 Year Warranty against delamination or deterioration. Plaster finishes are not warranted for crazing (cracks on the surface of concrete finishes), discoloration, staining or mottling due to ultraviolet sunrays, local water, wrong use of chemicals or from lack of cleaning.
Plaster Finish Warranty Coverage: Years 1 through 3 ‐ 100%, Year 4 – 50%, Year 5 – 40%, Year 6 through 10 – 20%. A Three Year Warranty on Electrical, Plumbing (Piping, Fittings and Valves). A Three Year Warranty on all Decking, Coping and Tile and has no warranty covering same regarding checking – crazing (cracks on the surface of concrete finishes), settling, discoloration or any damage occurring to pool resulting from decks and walks not installed in accordance with Contractor specifications in the warranties herein. Warranty is not covered if any work is performed by any entity or person other than Contractor during warranty periods. Contractor has the sole right to replace and repair any warranted item.
The warranties are effective only if: Buyer has complied with all the Terms and Conditions, payments and other provisions of this contract, Buyer fails to comply with decking installation requirements as set forth by the Contractor, Buyer pays all and any monies due Contractor for pool installation, change orders or service calls.
Limitations: Implied warranties are limited in duration to the duration of the written Limited Warranty. No warranty extends to any part of the swimming pool, its equipment or appurtenances thereto which are caused by any of the following conditions or events: Defects, damages or failures caused by abuse, lack of reasonable care, lack of necessary maintenance, improper operation, vandalism, acts of God or normal wear. Defects, damages or failures caused if the pool is not kept full, if the water table is above the lowest point of the pool, if caused by earthquake, war, earth movement, earth fill movement or of disasters not caused by Contractor such as explosions, wrecking and the like. Defects, damages or failures caused to plumbing lines. filter, motors and pumps by freezing, by substitution or addition of equipment or service not expressly authorized by Contractor which affect the operation or designed use of the pool. Defects, damages or failures caused by surface or subterranean drainage under or around pool or as a result of expansive soil. Contractor assumes no liability regarding determination of existence of expansive soil. Defects, damages or failures caused to the pool or equipment by the use of gaseous chlorine introduced by manual feed, metered by electronic means or chlorine generators. Defects, damages or failures caused by work performed by the Buyer, equipment or materials supplied by the Buyer, any subcontractor or third party hired by the Buyer for work relating to the construction of the swimming pool.
